Terms and Conditions

The rules listed below form the terms and conditions of the competition. Please note that by submitting an entry, you are deemed to have agreed to and accepted these rules. This competition is administered by Bukit View Secondary School and PUB, Singapore’s national water agency and will be acknowledged as the "Organising Committee" thereafter.

  1. Entrants shall submit the actual copy of video in MP4 format to the designated address:

  2. The closing date for entries is 14 Oct 2011, 5pm sharp.
  3. Participants acknowledge that all copyright and other rights in the video are solely and exclusively owned by Organising Committee. The participants guarantee that the contents of the video will not be obscene or defamatory.
  4. Each video must be the original creation and work of the entrant, in its entirety.
    Participants must not incorporate in any video any sample of any copyrighted materials from films, television shows, videos or any other copyrighted works. No changes or additions to the sound recording of the video are authorised.
  5. The Organising Committee shall also not be liable for any damage or loss of any kind, howsoever caused as a result (direct or indirect) of the production of the video, including but not limited to any damage or loss suffered as a result of reliance on the Contents contained in or available in the video.
  6. If any provision of the terms and conditions is determined to be invalid or unenforceable, then such invalidity or unenforceability shall not have any effect on any other provision of these terms and conditions, all of which shall remain valid and enforceable.
  7. All visual elements embodied in each video must be fully cleared by the participants for Organising Committee's use as part of the competition and for any promotional use.
  8. Participants must ensure that such use of their video as part of the competition and any use by Organising Committee shall not infringe the rights of any third parties or any applicable law, regulation, code, order, direction or bye-law and entrants shall indemnify and keep Organising Committee indemnified from and against any claim, damage, loss (whether foreseeable or not), liability or cost including reasonable legal fees in respect thereof.
  9. By entering the competition, participants warrant and confirm that they grant (or waive as applicable) and have obtained all necessary rights, licences, consents and permissions from all persons rendering performances in relation to their video(s), including but not limited to consents from all persons whose performances are reproduced in the video(s) or otherwise and including moral rights waivers and those consents licenses and permissions required under Part II of the Copyright Designs and Patents Act 1988 (or any modification or re-enactment thereof) in order that Organising Committee may make the fullest use of the video(s). If any such consents, permissions or any clearances have not been properly and legally obtained, then the entrant, upon submitting the video(s), agrees to indemnify and keep Organising Committee fully indemnified from and against any claim, damage, loss (whether foreseeable or not), liability or cost including reasonable legal fees arising out of any failure to obtain such consents.
  10. Participants will not reproduce or otherwise use, transmit, share, download, rip or exploit the video other than for the purposes of the competition and in strict accordance with these Terms and Conditions.
  11. By entering the competition, participants agree that Organising Committee shall be under no obligation to exploit, distribute and/or exhibit any video(s) and the entrants shall have no claim against Organising Committee in this regard.
  12. The winner will be the participant who submit the best video, as determined by Organising Committee in their absolute discretion
  13. The Winner will be selected in February 2012.
  14. The winners will be notified by telephone and/or email within seven (7) working days of the winner being selected. In the event that Organising Committee cannot for any reason contact any winner by midnight two working days after the above notification dates, they reserve the right in its discretion to draw another winner or to determine that there shall be no winner.
  15. The Organising Committee's decision is final. No correspondence will be entered into.
  16. The Organising Committee reserves the right to select an alternative winner in the event that Organising Committee has reasonable grounds for believing that a selected winner has contravened any of these Terms and Conditions of entry
  17. The winner may be required to provide a written acknowledgement of acceptance of all Terms and Conditions of the competition prior to receiving their prize.
  18. The Organising Committee can accept no responsibility for entries lost, delayed, misdirected, damaged or undelivered. Incomplete and/or illegible entries will be disqualified. Mute shall not be responsible for technical errors in telecommunications networks, Internet access or otherwise, preventing entry to the competition.
  19. By entering the competition, participants acknowledge that they may be required to be used in publicity without further consent or payment. Such publicity may include without limitation the participant’s video, and their name and/or likeness, voice, photographs and/or video footage of the participant, biographical information provided by the entrants/winners and/or any statement made by them concerning the competition and/or the prizes. Participants agree that any or all such elements may be used by the Organising Committee in any and all media in perpetuity throughout the world as the Organising Committee in their sole discretion see fit but the Organising Committee shall have no obligation to include an entrant in any publicity whatsoever.
  20. The Organising Committee shall not be liable to the winners and/or their guests for any loss or damage howsoever caused (whether in contract, tort or statutory duty or otherwise) arising out of or in connection with the competition and/or prize and the video submitted by such winners and/or their guests. This exclusion does not apply to damages based on personal injury or death nor to any other damages caused by gross negligence or intent of Organising Committee and/or its servants. By entering the competition, participants waive to the full extent permissible by law, any and claims that they may have against Organising Committee and its licensees.
  21. All entrants agree to be bound by these Terms and Conditions, which may be amended or varied at any time by Mute on notice.
  22. These competition Terms and Conditions shall be governed by and construed in accordance with the laws of the Repubic of Singapore and the courts in Singapore shall have exclusive jurisdiction in relation to any dispute arising therefrom.
